^{By accessing or using Snowball ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our platform.}

1. Description of Service

_{Snowball is a SaaS platform that enables Twitch streamers to automatically collect clips created by whitelisted clippers, convert them to short-form content, and schedule posts across multiple social media platforms including YouTube, TikTok, and other supported networks.​}

_{The Service includes:}

• _{OAuth authentication with Twitch, YouTube, and TikTok}
• _{Automatic clip retrieval from whitelisted Twitch clippers (every 10 minutes for the last 24 hours)}
• _{Clip conversion to short-form vertical video format}
• _{Scheduled posting to connected social media accounts (maximum 3 posts at up to 3 defined time slots per day)}
• _{Clip metadata management and duplicate prevention}

2. Eligibility and Account Registration

_{You must be at least 18 years old to use Snowball. By registering, you confirm that:​}

• _{You are a legitimate Twitch streamer with valid account credentials}
• _{You have the legal right to authorize access to your social media accounts}
• _{All information provided during registration is accurate and current}

_{You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account}^.​

3. User Responsibilities

Content Ownership and Rights:

• _{You must own or have appropriate rights to all clips uploaded through the Service​}
• _{You are solely responsible for ensuring that clips created by your whitelisted clippers comply with Twitch Terms of Service and applicable platform guidelines}
• _{You must not use the Service to post content that infringes copyright, violates third-party rights, or contains illegal material}

_{Whitelist Management:}

• _{You are responsible for managing your clipper whitelist and ensuring authorized clippers create appropriate content}
• _{Snowball is not liable for content created by third-party clippers on your behalf}

_{Platform Compliance:}

• _{You agree to comply with TikTok Developer Terms of Service, YouTube API Terms, and Twitch Developer Agreement​}
• _{You must respect rate limits and usage quotas imposed by connected platforms}

4. OAuth and Data Access

_{By connecting your social media accounts through OAuth, you explicitly authorize Snowball to:}

• _{Access and retrieve clips from your Twitch channel created by whitelisted clippers}
• _{Upload videos to your connected YouTube, TikTok, and other social media accounts at scheduled times}
• _{Store encrypted access tokens and refresh tokens to maintain authentication​}

_{You may revoke access to any connected platform at any time through your Snowball account settings. Upon revocation, Snowball will immediately delete associated access tokens from our database.}​

5. Service Plans and Billing

_{Current Status:
Snowball is currently in beta/MVP phase. Commercial pricing will be announced prior to general availability.}

_{Planned Pricing Structure:}

• _{Two paid subscription tiers with monthly billing}

_{Payment terms, refund policies, and subscription management details will be provided in a separate Pricing and Billing Policy before commercial launch.}​

6. Service Availability and Modifications

_{Snowball strives to provide reliable service but does not guarantee uninterrupted access. We reserve the right to:​}

• _{Modify, suspend, or discontinue any aspect of the Service with reasonable notice}
• _{Perform scheduled maintenance that may temporarily affect availability}
• _{Update features, API integrations, or supported platforms}

_{We will provide advance notice of material changes when feasible.}​

7. Prohibited Activities

_{You must not:}

• _{Use the Service to upload content that violates platform guidelines, copyright laws, or community standards​}
• _{Attempt to reverse engineer, decompile, or access Snowball's source code or infrastructure}
• _{Circumvent rate limits, scheduling restrictions, or technical limitations}
• _{Resell, redistribute, or provide unauthorized access to the Service}
• _{Use automated tools (bots, scrapers) to access Snowball beyond its intended functionality}
• _{Interfere with other users' accounts or the Service's operation}

8. Intellectual Property

Snowball Platform:
_{All software, designs, logos, and proprietary technology underlying Snowball remain the exclusive property of Snowball and are protected by French and international copyright laws.​}

_{User Content:
You retain all ownership rights to your clips and posted content. By using the Service, you grant Snowball a limited, non-exclusive license to process, store temporarily (in /tmp), and transmit your clips solely for the purpose of providing the scheduling and upload functionality.​}

_{Snowball does not claim ownership of your content and will not use it for purposes beyond Service operation without your explicit consent.}​

9. Limitation of Liability

To the maximum extent permitted by French law:​

• _{Snowball is provided "as is" without warranties of any kind}
• _{We are not liable for content posted to your social media accounts through the Service, including scheduling errors, formatting issues, or platform rejections}
• _{We are not responsible for actions taken by third-party platforms (TikTok, YouTube, Twitch) including account suspensions, content removals, or policy violations}
• _{Our total liability for any claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim}

Platform-Specific Disclaimers:

• _{TikTok, YouTube, and Twitch may change their APIs, policies, or Terms of Service without notice, which may affect Snowball functionality​}
• _{Snowball is not affiliated with or endorsed by TikTok, YouTube, Twitch, or Instagram}

10. Data Protection and Privacy

_{Your use of Snowball is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with GDPR and applicable French data protection laws.}​

11. Account Termination

Your Rights:
_{You may terminate your account at any time through account settings. Upon termination, we will delete your personal data in accordance with our Privacy Policy.}​

Our Rights:
_{We reserve the right to suspend or terminate accounts that:}

• _{Engage in fraudulent, abusive, or illegal activities}
